Donald Trump is positioned as the probable Republican Party nominee for the upcoming presidential race. To solidify this status, he must secure victory in the primary race, a milestone contingent on his inclusion on the ballot. A recent legal ruling, favoring Trump, emerged following attempts to prevent his presence on the Michigan ballot.

On November 14, a judge in Michigan rejected an attempt to bar Trump from being listed on the primary race ballot. The accusers contended that he was not qualified for another presidential candidacy, referring to the insurrection clause outlined in Section 3 of the 14th Amendment.

This provision specifically disqualifies individuals who have participated in insurrection or rebellion during their time in office. Its inclusion in the Constitution was intended to prohibit former Confederacy members from occupying public office.

Judge James Robert Redford determined that disqualifying a candidate based on the 14th Amendment is a nonjusticiable, political matter that should be resolved exclusively by Congress. The decision received backing from Michigan Secretary of State Jocelyn Benson. The plaintiffs in the case are currently seeking a review of the ruling from the Michigan Supreme Court.

Earlier this month, Trump secured a victory in a comparable lawsuit in Minnesota. Similar to this case, the plaintiffs contended that he should be ineligible due to his actions following the 2020 election.

Nevertheless, the state Supreme Court concluded that they lacked jurisdiction concerning whether his name should be included on the Republican Party’s ballot for selecting their candidate.

There is another lawsuit aiming to prevent Trump from being on the ballot in Colorado. Once more, the plaintiffs are invoking the insurrection clause. Similar to the other instances, the likelihood of success for this case seems low. A judge in New Hampshire dismissed a comparable case.

Adversaries of Trump persist in their attempts to prevent his return to the White House and resuming his previous activities.
